	TERMS AND CONDITIONS The following are the terms and conditions for use of the Pettags.com affiliate including without limitation design, reproduction and shipment, as well as, other services which may be offered from time to time by Pettags.com under your account member name (each feature individually and collectively referred to as the "Service"). Please read them carefully. This Service is provided to individuals who are at least 18 years old. BY CLICKING THE "SUBMIT" BUTTON AND COMPLETING THE REGISTRATION PROCESS, YOU ARE STATING THAT YOU ARE ELIGIBLE FOR AN ACCOUNT AND THAT YOU AGREE TO BE BOUND BY ALL OF THESE TERMS AND CONDITIONS OF THE SERVICE ("TOS"). The Service is offered to you conditioned on your acceptance without modification of the terms, conditions, and notices contained herein. (A) The Customer guarantees, warrants, and certifies that it does not infringe upon or unlawfully, wrongfully, or improperly use any trademark, trade name, service mark, or copyright owned or claimed by another. The Customer further guarantees, warrants, and certifies that to its knowledge, no action, suit, proceeding, or investigation has been instituted or threatened relating to any trademark, trade name service mark, copyright formerly or currently used by the Customer in connection with the services rendered by the Company. The Customer shall indemnify, defend, and hold harmless the Company from and against any and all liabilities, costs or expenses which the Company might incur arising from or relating to the Customer's infringement upon, or unlawful, wrongful, or improper use of a trademark, trade name, service mark, or copyright owned or claimed by another. (B) Furthermore, the Company shall not be liable for any injury or damage to any person or property whatsoever by reason of, or in any manner growing out of, the Customer's infringement upon, unlawful, wrongful, or improper use of a trademark, trade name, service mark, copyright, owned or claimed by another. (C) Pettags.com reserves the right to decide in its sole discretion whether to reproduce images presented to it in connection with its business as well as the sole discretion to deny the customer the ability to utilize Pettags.com website for the sale of their goods. (D) Customer certifies that he is over the legal age 18 and has the ability to enter into any and all transactions on Pettags.com website. (E) Other Grounds for Termination In addition to the foregoing, we will immediately terminate your participation in the Pettags.com Affiliate Program if we believe you have engaged in any of the following: - Altering by electronic, mechanical or automated means or other technologies, that may now exist or come into existence, the Pettags.com webmaster affiliate code or Pettags.com site URLs belonging to or identified with accounts other than your own, or causing the modification or substitution of Pettags.com webmaster affiliate code or Pettags.com site URLs belonging to or identified with accounts other than your own that may reside within or originate from a third party system in the form of bookmarks, cached pages, cookies or other stored forms that may be passed to the Pettags.com system by user operation of said third party system. - Any form of spamming including, but not limited to unsolicited email, IRC postings, newsgroups, and/or instant messaging clients; - Providing inaccurate or incomplete information to COMPANY concerning your identity, bank account, address or other required information; - Attempts to cheat, defraud or mislead us in any way; - Misrepresenting to the public the terms and conditions of the Pettags.com website or your site(s); - Promotion of Pettags.com website on password sites, MP3 sites or warez sites; (F) Adult Sites (G) Customer agrees to display a pettags.com banner ad and/or link on customer's proprietary web site. Adult-oriented sites, pornography and sex-related merchandising are prohibited. This includes sites that may infer sexual content or provide links to adult content elsewhere. This is also true for sites that promote any illegal activity or content that may be damaging to our servers or any other server on the Internet, or provide links to such sites. Any customer caught in direct violation of these terms and conditions will have their account terminated and forfeit all commissions earned.
